Basic Separation Agreement

$499Coming soon

Planned price, including review by an Ontario lawyer for eligible cases. Not yet available for purchase.

A separation agreement is a written contract that records how you and your former spouse or partner have agreed to handle parenting, support, property and debts after separating. Our guided version builds the agreement from lawyer-approved clauses, chosen by fixed rules from your answers.

What it will cover

  • Parenting — decision-making and parenting time
  • Child support, including special expenses
  • Spousal support, or a release of it
  • Property division and equalization
  • The matrimonial home and household contents
  • Debts, pensions, insurance and releases

A good fit if

  • You both live in Ontario and have separated
  • You already agree on the main terms
  • You will both share full financial disclosure
  • Your finances are relatively straightforward

Important to know

  • The lawyer review advises the party who purchases the package. Your former spouse or partner should get their own independent legal advice.
  • An agreement can be set aside if it was signed without full financial disclosure, under pressure, or without understanding its terms.
  • Situations involving family violence, a business, complex pensions or disputed issues are referred to a lawyer.

Answer a few questions to see whether the Basic Separation Agreement suits your situation. Your answers stay in this browser tab — nothing is sent or saved.

  1. 1.Do you and your spouse or partner both live in Ontario?
  2. 2.What was your relationship?
  3. 3.Have you separated?
  4. 4.Do you agree on the main terms — parenting, support and dividing property?
  5. 5.Has there been any family violence, threats, or pressure to agree?

This includes physical, emotional, financial or sexual abuse, and coercive or controlling behaviour.

  6. 6.Has either of you started a family court case?
  7. 7.Will you both share complete financial information — income, assets and debts?

An agreement made without full financial disclosure can be set aside by a court.

  8. 8.Does either of you own a business or corporation, a farm, trust interests, or property outside Ontario?
  9. 9.Does either of you have a workplace defined-benefit pension, or a pension already being paid?
  10. 10.Does either of you earn more than $150,000 a year, or have self-employment or irregular income?
  11. 11.Is your spouse or partner willing to get their own independent legal advice?

One lawyer cannot advise both parties. Independent legal advice for each person makes the agreement much harder to challenge later.
